COMPATIBILITY OF LAW 13.964/2019 WITH THE PRINCIPLE OF NON-SELF-INCRIMINATION IN THE BRAZILIAN JUDICIAL SYSTEM

This study analyzes the requirement of confession in the Non-Prosecution Agreement, discussing its compatibility with the principle of non-self-incrimination. Initially, it addresses the evolution of Brazilian criminal procedure, highlighting the incorporation of consensual mechanisms aimed at increasing efficiency and reducing judicial overload. It then examines the legal framework of the agreement and its requirements, with particular emphasis on the formal and detailed confession. The research presents doctrinal divergences on the subject and analyzes the compatibility of this requirement with fundamental guarantees, such as the right to remain silent and the presumption of innocence. Based on bibliographical and jurisprudential research, it concludes that the mandatory nature of confession may violate the principle of nemo tenetur se detegere, insofar as it imposes a condition that compromises the voluntariness of the investigated person and the logic of a democratic criminal justice system.
