THE PROMOTIONAL FUNCTION OF BIDDING PROCESSES FOR DEVELOPMENT

This article analyzes the new Public Procurement Law (Law No. 14.133), focusing on innovations related to incentives for sustainable development within the scope of contracts carried out by the Public Administration. The principle of sustainable national development is among the principles and objectives of public procurement, highlighting the legislator's intention to attribute an extra-focused function to the bidding processes, beyond the mere acquisition of goods and services. It is observed, through the provisions included in the aforementioned law, that public procurement is not an end in itself, but must fulfill its social function and contribute to the economic, social, and environmental development of society. The article explores concepts related to public procurement, sustainable development, the instrumentalization of public procurement to achieve this scope, and the need to observe this principle. For the development of the research, the bibliographic review method was used, through the study of applicable legislation, doctrinal works, scientific articles, and jurisprudence on the subject.
