Pedophilia on the Internet: Legal Challenges and Protection Mechanisms for Children and Adolescents

This paper analyzes the legal challenges related to online pedophilia and the mechanisms for protecting children and adolescents within the Brazilian legal system. The research begins with the understanding that the advancement of digital technologies and the expansion of internet access have significantly transformed forms of social interaction, but have also contributed to increased vulnerability of children and adolescents in the virtual environment. In this context, criminal practices such as the sharing of child pornography, digital grooming, sextortion, and other forms of online sexual exploitation stand out. The study addresses the conceptualization of digital pedophilia from legal and social perspectives, emphasizing that the Brazilian legal system does not criminalize the psychological condition of pedophilia, but severely punishes conduct related to the abuse and sexual exploitation of children and adolescents. Furthermore, it discusses the historical evolution of these practices and how the internet has facilitated the anonymity of criminals and the rapid dissemination of illicit content. In the legal field, this study analyzes provisions of the 1988 Federal Constitution, the Statute of Children and Adolescents, the Penal Code, and the Brazilian Civil Rights Framework for the Internet, highlighting the changes introduced by Law No. 11.829/2008. The work also emphasizes the importance of preventive public policies, digital education, and joint action between the State, family, and society. It concludes that, despite legislative advances, challenges related to investigation, oversight, and international cooperation in combating online child sexual exploitation persist.
