CRIMES OF VIOLENT ABOLITION OF THE DEMOCRATIC RULE OF LAW AND COUP D’ÉTAT AND THE INAPPLICABILITY OF ATTEMPT IN THE ACTS OF JANUARY 8TH

This article analyzes the legal nature of the crimes foreseen in articles 359-L and 359-M of the Brazilian Penal Code, inserted by Law 14.197/2021, which respectively typify the violent abolition of the Democratic Rule of Law and a coup d'état. The general objective is to demonstrate that these offenses are crimes of attempt or undertaking, a dogmatic category in which attempt is equated to consummation, making the mitigating circumstance foreseen in article 14, sole paragraph, of the Penal Code inapplicable. This research uses a deductive method, with a qualitative approach, of a bibliographic-documentary nature, using as primary sources the relevant legal provisions and as secondary sources the Brazilian penal doctrine and the judgments issued by the Supreme Federal Court in the cases relating to the acts of January 8, 2023. It concludes that the application of the mitigating circumstance of attempted crimes in these cases constitutes a hermeneutical error, since the typical structure of the crimes in question encompasses the iter criminis from the beginning of the execution.
