TOKENIZATION OF REAL ESTATE PROJECTS AS AN INNOVATIVE FUNDRAISING APPROACH IN THE CONSTRUCTION INDUSTRY

The tokenization of real estate developments presents itself as an innovative alternative for raising resources in the construction sector, using blockchain technology to transform physical assets into tradable digital representations. This study analyzes the technical, legal, and operational foundations of this process, based on a literature review and an applied case study. Tokenization allows the fractionalization of properties into digital tokens, facilitating access for small and medium investors, increasing market liquidity, and reducing intermediation costs. However, its implementation faces significant challenges, especially regarding the principle of registry publicity, legal security, and adaptation to the Brazilian real estate registration system. Proposals were identified to reconcile technological innovation with legal protection, such as the creation of a dedicated asset fund, the establishment of a real estate custodian, the annotation of digital transactions in the property's registration, and the issuance of tokens by the real estate registry itself. It is concluded that although tokenization offers benefits such as speed, transparency, and democratization of investment, its consolidation depends on the creation of a specific regulatory framework and the secure integration between the digital and legal environments.
