THE SOVEREIGNTY OF VERDICTS IN THE FACE OF CONSTITUTIONAL GUARANTEES: A BALANCING OF JURY TRIALS AND DUE PROCESS OF LAW

This academic article analyzes the complex and often conflicting relationship between the principle of the sovereignty of verdicts, a cornerstone of the Brazilian Jury Court, and the fundamental guarantees of due process of law. Constitutionally established as a fundamental right and an entrenched clause, the Jury Court embodies popular participation in the Judiciary, granting ordinary citizens the jurisdiction to judge intentional crimes against life. However, the system of judgment by lay jurors, who decide based on their intimate conviction and without the need to justify their decisions, raises tensions with essential principles of the Rule of Law, such as the requirement for reasoned judicial acts, the adversarial principle, and the parity of arms. This study, through bibliographic research, explores this issue, focusing on the technical (in)capacity of jurors and the possibility of acquittal by clemency, even when in apparent dissociation with the body of evidence. The objective is, therefore, to weigh the limits and harmonization between the democratic legitimacy of the jury and the imperative of criminal procedural guarantees.
