ALGORITHMIC SUBORDINATION AND (NON) RECOGNITION OF THE EMPLOYMENT RELATIONSHIP: A CRITICAL ANALYSIS OF UBERIZATION IN BRAZILIAN LABOR LAW (TRT-19 AND TST, 2016–2025)

This study critically examines how Brazilian labor courts have treated algorithmic subordination and the employment relationship in platform-mediated work, focusing on the Regional Labor Court of the 19th Region and the Superior Labor Court between 2016 and 2025. The research combines critique of political economy, labor sociology and labor law doctrine to argue that uberization is a contemporary form of labor organization marked by risk transfer, subordinated self-management and intense algorithmic mediation. Methodologically, the study combines bibliographic review, qualitative content analysis and descriptive statistics. The spreadsheet originally gathered 50 nationwide screening records; after methodological refinement, the main corpus was restricted to 21 cases with participation of TRT-19 or TST in the procedural path. Within this corpus, the dissertation differentiates merit decisions, admissibility stages and one case resolved by settlement, thus avoiding undue homogenization. Results suggest that unfavorable outcomes prevail in the adjudicated set of this intentional corpus, especially within the subgroup of TST merit decisions, although a counter-line of decisions still recognizes labor subordination through digital means. The conclusion is deliberately cautious: the corpus points to an internal restrictive tendency in a relevant portion of the decisions, but it does not support statistical generalizations about all platform-work litigation in Brazil.
