A DESTINAÇÃO DOS BENS DIGITAIS POST MORTEM

O presente artigo tem como finalidade discutir a destinação dos bens digitais post mortem. Com o crescimento da evolução tecnológica, a herança digital vem ganhando cada vez mais espaço, existindo, assim, uma insegurança muito grande em relação à transmissão desses bens digitais. Isso porque, ainda não há uma forma definida de como tratá-los no mundo jurídico, mas algumas plataformas digitais estão implantando novas políticas de privacidade em relação às contas dos usuários falecidos. Sendo assim, por meio de pesquisa bibliográfica e documental, o presente estudo, se atentou a analisar normas jurídicas e jurisprudência, acerca do entendimento sobre a destinação dos patrimônios digitais que são deixados pelas pessoas em ambientes virtuais e como seria feito destinação deste patrimônio, após o falecimento da pessoa humana.
