This study analyzes the complex issue of criminal liability for individuals diagnosed with psychopathy in Brazil, considering the challenges faced by the criminal system in dealing with this condition. Psychopathy, characterized by traits such as lack of empathy, impulsivity and manipulation, presents significant difficulties in assessing culpability and applying penalties. The Brazilian legal system, which still lacks specific provisions to address this issue, faces the arduous task of balancing the protection of society with the rights of these individuals, considering the complexity of their disorders. The methodology used in this study is Bibliographic Review, in which academic articles, case studies and relevant jurisprudence published in the last ten years were analyzed, ensuring an updated view of the topic. This approach allowed for a critical and in-depth analysis of the different perspectives and challenges related to punishability in crimes committed by psychopaths. The results point to the need for reforms in the Brazilian legal system, in order to include more effective and humanized approaches to the management of crimes committed by individuals with psychopathy, balancing justice, public safety and the possibility of social reintegration
