Abstract

The aim of this study is to analyze the implications of the restrictive sentence of freedom as regards the reinsertion of the convicted psychopath to society. The methodology adopted was a bibliographic search. This research demonstrated that the penalty, within the penal system, is understood as a retribution for the violation of the laws imposed by the society. As a rule, the purpose of the penalty is to prevent man from committing a criminal offense. In conclusion, this study points out that in the Brazilian penal system the psychopath is not considered sick, because he is aware of his actions. Psychopathy, being considered a psychological disorder that has no cure, poses a serious problem for the reintegration of these individuals into society. In the Brazilian prison system.
