TUTELA ANTECIPADA ANTECEDENTE E AS LACUNAS LEGISLATIVAS DIANTE DA INÉRCIA RECÍPROCA DAS PARTES

O presente trabalho tem por fito abordar as possíveis soluções processuais diante da inércia das partes em uma demanda de tutela de urgência antecipada requerida em caráter antecedente. Nesse sentido, apresenta-se as noções gerais sobre tutela provisória, com enfoque nas suas espécies, características e distinções; os requisitos para a concessão da tutela antecipada; o procedimento e os pressupostos para a sua concessão em caráter antecedente, bem como a possibilidade da sua estabilização, oportunidade em que se diferencia coisa julgada de estabilidade. Por fim, apresenta-se as possíveis soluções processuais diante da inércia reciproca das partes, para a extinção do processo com estabilização da tutela e sobrevida dos seus efeitos, com vistas a um processo econômico, célere e acima de tudo eficiente, corolários do princípio da duração razoável do processo, albergado no art. 5º, inciso LXXVIII da CRFB/88.
