O objetivo desse artigo foi discorrer sobre Amicus Curiae. Amicus Curiae, companheiro da corte portuguesa, é a terceira pessoa ativa em um processo ordenado pelo tribunal. Sua aparência volta para a direita. O estilo britânico do passado é amplamente utilizado nos países de direito consuetudinário. No Brasil, a instituição foi legalizada pela primeira vez por meio da Lei nº 6.385/ 1976, entretanto, só recebeu uma verdadeira consideração após sua incorporação às leis que instituíram a Ação Direta de Inconstitucionalidade, Ação Declaratória para Constituição e Ação de descumprimento de Preceito Fundamental. O Código de Processo Civil 2015 previu o instituto, visando disciplinar o amigo do tribunal por meio art. 138, autorizando seu uso tanto no primeiro grau quanto nos tribunais. Para que o amicus curiae intervenha, há previsão de requisitos quanto ao tema, resultados sociais e representação adequada da pessoa ou organização que deseja fazêlo. Seu uso é muito importante por viabilizar a participação popular nos julgamentos e pelo fortalecimento de diversos princípios constitucionais.
