A RESPONSABILIDADE CIVIL E A TEORIA DA PERDA DE UMA CHANCE APLICADA AO DIREITO DO TRABALHO

O presente artigo tem finalidade de apresentar a evolução e aplicação acerca do tema proposto, com intuito de contribuir com os estudos já existentes e não de esgotá-lo. Trata-se de tema relativamente novo, que vem ganhando força a cada dia, e com isso, surge a responsabilidade civil pela perda de uma oportunidade, decorrente das relações trabalhistas nas fases pré-contratual, em que é assegurada a reparação de danos sofridos pelo empregador através da perda de uma chance, na fase contratual e pós-contratual, com objetivo de indenização pela perda de uma chance sofrida, mostrando que há certa insegurança jurídica acerca do tema, uma vez que não há disposição expressa no Código Civil, havendo apenas normas “gerais” aplicadas a essa teoria por analogia de acordo com o caso concreto, apesar de o Direito do Trabalho não vedar a aplicação de tal teoria em suas relações, sendo então admissível a aplicação de indenização pela perda de uma chance nas relações trabalhistas, conforme ordenamento jurídico cível.
