RESPONSABILIDADEPENAL DA PESSOA JURÍDICA NAS LEIS DE CRIMES AMBIENTAIS

A preservação do meio ambiente é um direito fundamental e uma preocupação
mundial. O Direito Ambiental busca proteger o meio ambiente e assegurar que os
responsáveis pela sua degradação sejam punidos, em conformidade com a lei. A lei
prevê a responsabilização penal das pessoas física e jurídica por crimes ambientais,
mas a questão da responsabilidade penal ambiental do gestor público é pouco
debatida. O presente estudo possui a finalidade de compreender o instituto da
responsabilidade penal da pessoa jurídica no Direito Ambiental. A necessidade de
se responsabilizar os danos está se tornando cada vez mais forte no ordenamento
jurídico brasileiro, principalmente no direito ambiental, no entanto, é necessário o
estabelecimento de limites para a utilização dos dispositivos de
ressarcimento. Conquanto, a responsabilização penal da pessoa jurídica já é uma
realidade no ordenamento jurídico pátrio, tendo se mostrado eficaz na prevenção e
repressão dos crimes ambientais. Para tanto, serão examinados o Direito Penal
Ambiental e os principais aspectos da Lei 9.605/98, que dispõe sobre as sanções
penas e administrativas derivadas de condutas e atividades lesivas ao meio
ambiente.
