O PAGAMENTO DE PENSÃO ALIMENTÍCIA ENTRE EX-CÔNJUGES

O propósito do presente trabalho de conclusão de curso é apresentar a possibilidade da concessão de pensão alimentícia entre ex-cônjuges em comum acordo com o ordenamento jurídico brasileiro, objetivando impedir, ou diminuir as consequências causadas pelo fim do vínculo conjugal, informar sobre a função social dos alimentos, do reconhecimento e proteção do Estado à “ amparando-a por meio de lei. Quanto ao instituto dos alimentos será feita uma análise geral sobre o tema, seus fundamentos, natureza jurídica, pressupostos, características, espécies e sujeitos, buscando sempre a igualdade entre os cônjuges, mesmo com o fim do vínculo conjugal. O estudo ainda versa sobre o poder familiar, o dever de mútua assistência e o princípio da solidariedade familiar, a relação de igualdade entre homem e mulher em prestar e solicitar alimentos conforme previsão da Constituição Federal de 1988(CF/88), e do Código Civil de 2002(CC/02). Ao final é avaliada a aceitação por parte da doutrina e jurisprudência, da possibilidade da obrigação de pensão alimentícia entre ex-cônjuges diante da legislação brasileira. No desenvolvimento dos fatos apresentados no texto, foi utilizado o método dedutivo, além de técnica de pesquisa bibliográfica, incorporando análise de legislação, doutrina, artigos e jurisprudência.
