AFETAÇÃO NA VIDA FINANCEIRA E À SAÚDE DA POPULAÇÃO BRASILEIRA

O presente artigo aborda o questionamento: Se a Judicialização da saúde, que busca resguardar o direito social fundamental à saúde do povo brasileiro, está servindo de palco à máfia instalada no SUS, ou se está havendo efetiva aplicação da política programática prevista na Constituição da República Federativa do Brasil? A efetivação do direito à saúde, conforme estatui a Constituição Federal, encarna um problema? A ineficiência do Estado na prestação deste direito, bem como suas práticas corruptivas foram os temas contemplados no presente estudo acadêmico. A busca pelo Poder Judiciário, produzindo decisões judiciais no intuito de fazer cumprir tal direito constitucional– zelar pela saúde do cidadão – não garantem ao propósito constitucional. O Estado, as mídias, os médicos, advogados, juízes dentre outros; estar-se-iam envolvidos em esquemas de medicamentos, etc. para superfaturamentos e obtenção de dinheiro fácil? Foram as questões aqui examinadas.
