UMA ANÁLISE DA REDUÇÃO DA MAIORIDADE PENAL SOB A ÓTICA DA CONSTITUIÇÃO FEDERAL DE 1988

O presente artigo científico possui como finalidade realizar uma análise acerca da redução da maioridade penal sob a ótica da Constituição Federal de 1988. Em outras palavras tem-se o intuito de verificar se proposta de emenda à Constituição tendente a diminuir a imputabilidade penal de dezoito para dezesseis anos estaria ou não em consonância com o Texto Constitucional. Ressalta-se que o presente assunto é relevante nos âmbitos jurídico e social, pois a redução da maioridade penal é um tema discutido há décadas, razão pela qual é importante esclarecer a possibilidade jurídica de sua realização. Dentre os dois posicionamentos doutrinários referentes a tal questão, aquele que defende a constitucionalidade de emenda constitucional tendente a reduzir a maioridade penal de dezoito para dezesseis foi o que apresentou argumentos mais concretos e fundamentados. Por fim, no tocante à metodologia de pesquisa adotada, é importante mencionar o respectivo estudo está fundamentado no método dialético, possuindo como técnica de pesquisa a revisão bibliográfica.
