RESPONSABILIDADE CIVIL DO ESTADO POR DANOS DECORRENTES DE ATOS JUDICIAIS

Tema que desperta grande interesse, não só dos estudiosos do Direito, mas da sociedade de forma geral, é a responsabilidade do Estado pelos danos causados na prestação do serviço público. Neste contexto, surge a complexa questão da responsabilidade civil por danos decorrentes de atos judiciais, tendo em vista o princípio da independência do magistrado e da intangibilidade da coisa julgada. O presente artigo visa esclarecer o entendimento doutrinário e jurisprudencial acerca das divergências que surgem em torno do assunto, contribuindo para solução de controvérsias e aplicabilidade da norma ao caso concreto. Realizou-se uma pesquisa bibliográfica com base no entendimento de doutrinadores como CAHALI (1996), CAVALIERI FILHO (2018), DERGINT (1994) e MEIRELLES (2003), dentre outros, com análise do atual entendimento jurisprudencial da Suprema Corte, procurando esclarecer as situações em que se admite a responsabilização estatal por tais atos, concluindo-se que somente nos casos expressamente previstos em lei é possível a responsabilidade civil do Estado por atos tipicamente judiciais, de forma a viabilizar o exercício da função jurisdicional.
