AS VANTAGENS, DESVANTAGENS E RESULTADOS PRÁTICOS DA DELAÇÃO PREMIADA NO BRASIL

Neste Artigo, busca-se estudar o instrumento da delação premiada. O principal
objetivo deste estudo é analisar a delação premiada no Brasil, destacando as suas
vantagens e desvantagens, visando compreender os resultados concretos deste
instrumento jurídico. Para tanto, executa-se uma revisão de natureza qualitativointegrativa que visa compreender as suas vantagens, desvantagens, enfatizando os
seus prováveis resultados práticos em subsequência. Considera-se como delação
premiada o benefício legalmente concedido ao réu que aceita cooperar em uma
determinada investigação policial, fornecendo provas consistentes, que incriminam
comparsas. Com o seu uso, criminosos que poderiam continuar impunes estão
suscetíveis ao experimento da justiça, correspondendo aos anseios sociais. Na
legislação pátria, este é um instrumento previsto em diversas normas. Ao término de
tudo, observou-se que a delação premiada, mesmo diante de alguns desacertos,
realmente é um instrumento de natureza jurídica em proeminência. Por consequência,
já oferece resultados práticos relevantes, o que implica no custeio do seu uso no
porvir.
