Abstract
This article aims to analyze the use of WhatsApp messages as evidence in labor lawsuits and their various interests, and whether such evidence is competent in court, given that in some cases, it is the essential and necessary criterion to prove the right of the requesting party.
To this end, this article presents a bibliographical compilation and study of the jurisprudential positioning of the courts on the relevant topic, divided into three preeminent affairs. Initially, it will address digitalized law in the information era, delving deeper into the usage of WhatsApp as the leading means of digital communication today. The second topic deals with definitions, principles, and classifications of evidence in labor lawsuits. Finally, the third topic analyzes the usage of conversations made via the WhatsApp app in labor lawsuits, demonstrating precedents in whether these conversations are indicated to form part of the evidentiary list of grievances.
