AUXÍLIO-RECLUSÃO: CONSIDERAÇÕES SOBRE O DIREITO FUNDAMENTAL DA PREVIDÊNCIA SOCIAL

Abstract: This article aims to analyze the benefit called imprisonment aid, provided for in the list of benefits of the General Social Security System and the controversy about this benefit, before the Brazilian population, demonstrating its impacts on the Brazilian society and the latest legislative changes, as well as to describe the relevance of the imprisonment aid through a survey of the amounts that are paid and present the legislative changes that have happened over the years. The question is: Is popular opinion capable of affecting a constitutional right such as imprisonment assistance? In the end, it is considered that public opinion has a concrete, almost permanent character, which can be easily aggregated into coherent legal positions, leading to the questioning of the need for such a benefit in favor of the family of the then prisoner.
