A (IM) POSSIBILIDADE DA ADOÇÃO INTUITU PERSONAE NO ORDENAMENTO JURÍDICO BRASILEIRO

This article aims at the legal and beneficial consequences arising from the adoption intuitu personae with a view to the principle of the best interest of the minor. Adoption intuitupersonae is the legal process by which an individual or couple seeks to adopt a child or adolescent based on a specific affective bond developed between the parties. This approach emphasizes the principle of the best interest of the child, ensuring that voluntary donations focus on the emotional, psychological and social well-being of the child. This principle takes into account factors such as stability, security and an environment conducive to the healthy development of children. Through Intuitive Personality Adoption, adopters seek to create a home environment that meets the emotional and practical needs of the minor and facilitates his/her integration and acceptance into the new family. The intuitupersonae adoption process includes rigorous adoptee assessments, interviews, home visits, and enrollment assessments to ensure a suitable environment. The central idea of the work is to present the legal and beneficial consequences arising from the adoption intuitu personae in favor of the principle of the best interest of the minor, so that the order of registration is lenient, and not absolute.
