Abstract

This article aims to analyze the Amicus Curiae and its systematization in the
New Code of Civil Procedure - Law No. 13,105/2015, including concept, origin, legal
nature, partiality and controversial aspects. The institute has a fundamental role to
legitimize judicial decisions, it is a third party that joins the process spontaneously or
provoked to provide subsidies to the judicial body, being necessary adequate
representation and link with the litigious issue. It is a third party admissible in
relevant cause process, specific theme and social repercussion, and may intervene
natural or legal person.
